Resumen
La investigación tiene como objetivo demostrar la ineficacia del procedimiento establecido por la CONVENCIÒN DE LA HAYA 1980 en lo que se refiere a la Sustracción Internacional de Menores, trámite que tiene como finalidad devolver al pupilo de manera voluntaria, ya que se activa desde el momento en que uno de los padres de familia sustrae ilegalmente al menor o menores del lugar donde conviven con su compañero o cónyuge, y por tal motivo la parte pasiva del asunto no puede ejercer su Derecho de Custodia y Visitas, efectivamente, siendo separada de sus hijos arbitrariamente, y quedando en la obligación de iniciar y tramitar un procedimiento arduo y complejo para devolver al menor al país donde ejercía la residencia habitual, sumándole, a lo anterior, la meta que nos hemos propuesto, en el presente trabajo, demostrar la ineficacia de los procedimientos establecidos en el momento de garantizar los derechos tanto de la autoridad parental como del descendiente.
Abstract
