It then becomes necessary to rethink the reasons set out in Article 315 of the Civil Code and in particular paragraph 2 "Having abandoned the Child", since according to Colombian law means the abandonment Article 266 "Legitimate Rights granted parents in the preceding paragraphs, it cannot claim the child has been taken by them to the house of foundlings, abandoned or otherwise." For this it is necessary to analyze what is contemplated in the legal and causal level of neglect and consider in this paper the types of abandonment, going to the serious implications they may have in NNA development. Therefore, a methodology based on a qualitative approach was developed; using content analysis documentary speaks a sentence referring to parental authority and neglect, thus the impact on children and adolescents as a research method. It is expected that the reader may like the authors verify the importance of the current legislation covering all forms of neglect as grounds for deprivation of parental rights, with the main findings that in any case any kind of abandonment is in the NNA one imminent risk in their overall development and violation of their fundamental rights, thereby NNA for the full development of his personality, needs conditions of love and understanding, wherever possible, grow up in the care and under the responsibility of parents, an atmosphere of affection and moral safety of order and material. If the above are altered this exception may be the best alternative to contribute to its development.     Abstract

    Dadas las actuales condiciones que la sociedad colombiana impone al modelo tradicional de familia, tomando como referencia los nuevos modelos, en su mayoría representados por familias mono parentales, asumiendo el otro como ausente en las relaciones entre padres e hijos, no se ha reconocido la necesidad de establecer tipos de abandono, que incurren en negligencia como lo son el abandono emocional o físico, que puede implicar graves efectos sobre el nivel psicosocial y físico del Nino, atacando a sus intereses conforme a lo dispuesto por la Constitución de Colombia. Entonces se hace necesario repensar los motivos establecidos en el artículo 315 del Código Civil y en concreto el apartado 2 "Después de haber abandonado el Nino", ya que de acuerdo con las leyes colombianas significa el abandono en el artículo 266 "Los Derechos legítimos concedidos a los padres en los párrafos anteriores, no se podrá reclamar en el Nino que ha sido tomado por ellos a la casa de expósitos, abandonados o de otra manera". Para esto se hace necesario realizar un análisis de lo que se contempla en el ámbito jurídico como causal de abandono y considerar en el presente escrito los tipos de abandono que son ampliamente conocidos, acudiendo a las graves implicaciones que estos pueden tener en el desarrollo de los NNA. Por lo tanto, se desarrollara una metodología basada en un enfoque cualitativo, utilizando como método de investigación el análisis de contenido documental una sentencia que habla en referencia a la patria potestad y el abandono, con ello las consecuencias en los NNA. Se espera que el lector pueda al igual que los autores verificar la importancia de que la legislación actual contemple todas las formas de abandono como causales de privación de patria potestad, teniendo como principales hallazgos que en todo caso cualquier tipo de abandono constituye en el NNA un riesgo inminente en su desarrollo integral y violación de sus derechos fundamentales, con ello el NNA para el pleno desarrollo de su personalidad, necesita condiciones de amor y comprensión, siempre que sea posible, deberá crecer al amparo y bajo la responsabilidad de los padres, en un ambiente de afecto y seguridad de orden moral y material. Si los anteriores son alterados esa excepción puede resultar la mejor alternativa para contribuir en su desarrollo integral.
