Fair, the criminal inflationism and the overload of the Colombian penal system with prohibitions beyond the substantial and procedural ordinary norms, is a characteristic of the penal legislation. Therefore, it will always be appropriate to do research on this legislative problem that generates a state of unconstitutional things when applied to our reality. The Constitutionality of the prohibitions of administrative benefits and subrogations penal contained in the article 199 of the law 1098 of the 2006, was established by the Constitutional Court by means of the sentence C-738 of 2008, making use of the test of constitutionality based on the freedom of configuration legislative clearly indicating that its unconstitutionality would result if it were disproportionate, unreasonable or contrary to the institution itself (in that case the principle of opportunity). From the structure of the work are developed the chapters aimed at establishing a state of the art from the constitutionalism, the guarantee and the criminal policy, to demonstrate that although the exequibilidad of the article 199 of the Code for Children and Adolescents has been declared, the norm It has become ineffective, since sexual crimes against minors continue to increase. Thus, such legislation is disproportionate to the legitimate end of child protection in Colombia through criminal law.     Abstract

    El presente trabajo de grado objeto de esta investigación, tiene como fin abordar las prohibiciones de beneficios y subrogados penales en la ley de Infancia y adolescencia (ley 1098 de 2006) desde la perspectiva de su in-constitucionalidad, haciendo un estudio jurisprudencial y doctrinal que nos lleven a establecer porque su aplicabilidad es desproporcionada y contraria los principio rectores en un estado social de derecho, a una política criminal mal establecida del sistema penal colombiano con prohibiciones más allá de las normas ordinarias, sustanciales y procedimentales. Desencadenado un inflacionismo penal y la sobre carga del sistema. Por eso, siempre resultará procedente hacer investigación sobre esta problemática legislativa que genera estado de cosas inconstitucionales al momento de ser aplicadas a nuestra realidad. La exequibilidad de las prohibiciones de beneficios administrativos y subrogados penales contenidos en el artículo 199 de la ley 1098 del 2006, fue establecida por la Corte Constitucional mediante la sentencia C-738 de 2008, haciendo uso del test de constitucionalidad basado en la libertad de configuración legislativa; señalando con claridad que su inconstitucionalidad devendría que si se comprueba la no procedencia del principio de oportunidad resultara desproporcionada, irrazonable o contraria a la institución misma. Desde la estructura del trabajo se desarrollan los capítulos encaminados a establecer un estado del arte desde el constitucionalismo, el garantismo y la política criminal, para evidenciar que si bien se ha declarado la exequibilidad del artículo 199 numeral 3º del Código de Infancia y Adolescencia, se inhibió de proferir un fallo de fondo frente a los numerales 7º y 8º de la mencionada norma. Es así que tal legislación es incongruente al fin legítimo de protección del menor en Colombia por vía del derecho penal.
