    Abstract

    El silencio administrativo es la abstención injustificada de los funcionarios que representan la administración, que están obligados a producir un acto o manifestación expresa de voluntad dentro de un plazo fijado por la ley, determinando una violación flagrante al derecho de petición, dando como resultado que se configure el silencio administrativo positivo o negativo. La figura del silencio administrativo declarada en contra de la administración pública genera obligaciones y consecuencias jurídicas tanto para la administración como para el peticionario por la vulneración del derecho fundamental de petición.
