It should be noted that due to the large growth companies this contract is necessary to improve the productivity of their services and benefits.     Abstract

    Este trabajo es importante ya que con él se puede analizar el contrato de la tercerización y en especial los efectos que esta tiene al contratar por este medio en salud, la tercerización de las actividades en la parte contractual es para que el tercero ejerza de manera más eficiente la prestación del servicio, el tercero debe ser especializado en realizar las labores propias de las dependencias bajo su propia autonomía y riesgo. El outsourcing es una contratación indirecta de trabajadores en donde la empresa especializada asume el pago de su nómina, las empresas que tercerizan no pueden violar los derechos fundamentales y laborales de los trabajadores, este tipo de contratos genera cierto tipo de controversias respecto de si la prestación del servicio si se presta de una manera eficiente y en cuanto a la debida contratación laboral del personal sin violar sus derechos laborales. Es de anotar que debido al gran crecimiento de las empresas este contrato se hace necesario para mejorar la productividad de sus servicios y prestaciones.
