It also allows to recognize the shortcomings of public works since state pre-contractual, contractual and post-contractual, ending in a session since the initial contract signed did not meet satisfactory, leaving part of the population of the city of Bogota in traffic chaos, because mobility problems this section large influx was affected directly from the start of construction of this street. We further conclude that the administration at the time, was plunged into a series of tax, disciplinary and criminal processes, with results that are still to be decided and to light have been a few who have been sanctioned for such activity. As well as the incalculable losses that the public has known for the various media and reports that both the Comptroller and the Attorney forward on this issue and that apparently is still indebted to the firm, by assignment, could culminate it.     Abstract

    Se pretendió establecer con la presente investigación, la revisión de todos y cada uno de los principios que en materia de contratación estatal rigieron para la construcción y puesta en marcha de la obra pública Fase III de Transmilenio, tramo de la calle 26, estudio que desde la lectura de varios artículos periodísticos, jurisprudencia, leyes, informes de entes de control, permitieron desglosar información que conllevaron a concluir sobre el desarrollo y ejecución del contrato No.137 de 2007. Así mismo permite reconocer las falencias de la obra pública desde su estado precontractual, contractual y pos contractual, terminando en una cesión de contrato por cuanto la firma inicial no cumplió a satisfacción, dejando a una parte de la población de la ciudad de Bogotá con grandes inconvenientes de movilidad. Concluimos además, que la administración de ese entonces, se vio inmersa en una serie de procesos de tipo fiscal, disciplinario y penal, con resultados que aún están por decidirse y que a la luz pública han sido unos pocos quienes se han visto sancionados por tal actividad. Así como también las pérdidas incalculables que la ciudadanía ha conocido por los diferentes medios de comunicación y los informes que tanto la Contraloría como la Procuraduría adelantaron sobre este tema y que al parecer, aún se encuentra en deuda con la firma que, por cesión, pudo culminarla.
