Finally, in the fourth chapter deploy the constitutional principles that have interference with job stability, deepening the principle of contradiction, which we believe should be applied before issuing the act of withdrawal or annulment of the employees named in provisional , ending with an answer to the legal problem.     Abstract

    Esta investigación se desarrollará en cuatro capítulos: en el primer capítulo expondremos la función pública en Colombia, generando un concepto de la misma, desde el origen del Estado, abarcaremos la temática del empleo público, su clasificación y las diferentes maneras de proveerlo. En el segundo capítulo desarrollaremos lo pertinente a la carrera administrativa su evolución histórica y de manera muy sucinta revisaremos los diferentes conceptos internacionales de la misma.En el tercer capítulo hablaremos de la provisionalidad dentro de la función pública, el nombramiento de estos empleados, responsabilidades y sanciones, la estabilidad laboral relativa que les ha otorgado la Corte Constitucional y el Consejo de Estado, así, como su debida desvinculación. Por último, en el cuarto capítulo desplegaremos los principios constitucionales que tienen injerencia en la estabilidad laboral, profundizando en la aplicación del principio de contradicción, que a nuestro juicio debe aplicarse antes de la expedición del acto de retiro o insubsistencia de los empleados nombrados en provisionalidad, para finalizar con una respuesta al problema jurídico planteado
