From this point of view, stay in jobs Administrative Career, are based on the different skills developed and continuously reached by public servants, which culminates in the performance evaluation, this being an important contribution to the subject of the Public Service concept generates no such server stability, thus having different factors to evaluate, as they are; merit, evaluation, compliance and promoting overall good. However, this situation creates in general insecurity and job instability for those who occupy these positions, because the employee named in provisional enjoys no immunity stability, and although it can not be removed without motivation, it must ensure provision of good service. Finally, the fact that he has not called for competition to provide employment, or can not yet provided the charge for competition, allowing it to be designated a replacement again in provisional.     Abstract

    En principio, por regla general las Entidades Públicas deben conformar su planta de personal, con servidores públicos adscritos a la Carrera Administrativa; no obstante lo anterior, la realidad en las entidades públicas es distinta, puesto que el ingreso de empleados que ocupan en provisionalidad cargos de carrera, se presume amparado por razones del servicio público, situación reflejada en la continua jurisprudencia favorable para proteger especialmente el retiro de los provisionales y los intentos infructuosos por inscribir automáticamente a estos en la carrera. Desde este punto de vista, la permanencia en los empleos de Carrera Administrativa, se fundamentan en las diferentes competencias desarrolladas y alcanzadas de manera continua por los servidores públicos, la cual culmina con la evaluación del desempeño, siendo esto un importante aporte al objeto de la Función Pública, concepto que no genera ninguna estabilidad a tal servidor, teniendo así diferentes factores a evaluar, como son; el mérito, la evaluación, el cumplimiento y la promoción del bien general. Ahora bien, esta situación genera de forma general una inseguridad e inestabilidad laboral para aquellas personas que ocupan estos cargos, pues el empleado nombrado en provisionalidad no goza de ningún fuero de estabilidad, y a pesar que no puede ser retirado sin motivación, éste debe garantizar la prestación del buen servicio. Finalmente, la circunstancia de que no se haya convocado a concurso para proveer el empleo, o si aún no puede proveerse el cargo por concurso, permite que se pueda designar al reemplazante nuevamente en provisionalidad.
