Through an analysis of the problems identified in the study of doctrine and jurisprudence the causes of this phenomenon are deducted and, through the methodology of strategic planning, an alternative that meets the expectations of stakeholders arises constituting the State as an organization under the law, and having as basis the primacy of public interest over private interest.     Abstract

    Este artículo examina la contradicción entre la ley y la práctica administrativa de una forma discrecional de contratación de personas naturales en el Estado colombiano. La licitación pública debe ser la regla general en la contratación estatal, donde hay factores de competencia, y principios como la pluralidad y el mérito, no obstante la contratación directa de servicios profesionales y de apoyo a la gestión es el modo de vinculación de contratistas más utilizada por la administración pública, donde para suscribir un contrato la administración no debe recibir previamente y evaluar varias propuestas para seleccionar la mejor. A través de un análisis de los problemas identificados en el estudio de la doctrina y la jurisprudencia se deducen las causas de este fenómeno y, por medio de la metodología de la planificación estratégica, se plantea una alternativa que satisface las expectativas de los grupos de interés que constituyen el Estado como organización, en el marco de la ley, y teniendo como fundamento la primacía del interés general sobre el interés particular.
