    Abstract

    La facultad especial que posee la administración pública para retirar de forma discrecional al personal uniformado miembro de las Fuerzas Militares y Policía Nacional, con el fin de prestar un mejor servicio y mejorar la institución, no puede ser entendido como un acto arbitrario que vulnere derechos fundamentales; toda vez que si bien no existe una norma positiva que regule y establezca un procedimiento para dicha actuación, si existen pronunciamientos jurisprudenciales que han delimitado el poder discrecional del administrador y han sentado las bases para garantizar que estos actos no vayan en contraposición de la constitución y la ley. Todo acto administrativo de retiro bajo la causal de discrecionalidad, debe nacer a la vida jurídica cumpliendo al menos tres requisitos: no debe ser arbitrario, debe ser acorde a los fines del Estado y deben existir unos motivos que propicien tal decisión; los cuales garantizan la legalidad del acto todo ello para evitar que el acto discrecional vaya en contraposición a lo preceptuado por la Corte Constitucional y Consejo de Estado.
